大陸架大陸架continentalshelf從海岸起在海水下向外延伸的一個地勢平緩的海底地區的海床及底土，在大陸架范圍內海水深度一般不超出200米，海床的坡度很小，一般不超過1／10度。國際法認為，大陸架是鄰接一國海岸但在領海以外的一定區域的海床和底土。沿海國有權為勘探和開發自然資源的目的對其大陸架行使主權權利。大陸架是一國領土在海水下的自然延伸，這是沿海國對大陸架享有某些主權權利的理論根據。大陸架總面積2710萬平方千米，占全球面積5.3％，約占海洋總面積7.5％。幾乎所有大陸岸外均有大陸架發育。大陸架地形比較平坦，但也可有起伏20米左右的丘陵、盆地和谷地等。大陸架蘊藏著石油、天然氣和其他礦物資源。世界上石油產量20％來自大陸架。大陸架上的水域也是海洋生物資源最豐富的地方。世界上漁獲量90％來自大陸架上面的水域。許多國家主張對大陸架行使主權權利，法律上的大陸架概念在不斷變化。首先對大陸架提出管轄權主張的是美國，隨后不少國家發表了類似的關于大陸架的聲明。1958年聯合國第一次海洋法會議通過的《大陸架公約》規定，大陸架是“鄰接海岸但在領海范圍以外，深度達200米，或深度超過此限度而上覆水域的深度容許開采其自然資源的海底區域的海床和底土”。據此，200米海水深度是國際法上確定大陸架的一個標準，技術上能夠開發也是一個標準。所以大陸架的范圍可隨技術的發展而擴大。1982年通過的《聯合國海洋法公約》規定：“沿海國大陸架包括其領海以外依其陸地領土的全部自然延伸，擴展到大陸邊外緣的海底區域的海床和底土，如果從測算領海寬度的基線量起到大陸邊的外緣的距離不到200海里，則擴展到200海里的距離。”關于沿海國對大陸架的權利，《公約》規定：“沿海國為勘探大陸架和開發其自然資源的目的，對大陸架行使主權權利”。這種權利是專屬的，即沿海國不勘探大陸架或開發其自然資源，任何人未經該國明示同意，均不得從事這種活動。但沿海國開發從測算領海寬度的基線量起200海里以外的大陸架非生物資源，須向國際海底管理局繳納一定的費用。大陸架的自然資源包括海床和海底的礦物和其他非生物資源，以及屬于定居種的生物，即在可捕獲階段在海床上或海床下不能移動或其軀體須與海床或海底土保持接觸才能移動的生物。
