《關于向國外送達民事和商事司法文書和司法外文書公約》《關于向國外送達民事和商事司法文書和司法外文書公約》ConventionontheServiceAbroadofJudicialandExtrajudicialDocumentsinCivilorCommercialMatters1965年11月15日訂于海牙。1970年3月5日生效。截至1992年5月31日，共有締約方29個。中國于1991年5月3日加入《公約》。《公約》共3章，31條，2個附件。第一章是司法文書。第二章是司法外文書。第三章是一般條款。附件1是向國外送達司法文書和司法外文書的請求書和證明書表格。附件2是被送達文書概要。《公約》適用于民事或商事案件中向國外送達的司法文書和司法外文書。《公約》規定，每一締約國應指定一個中央機關，負責接收來自其他締約國的送達請求書，并予以轉遞。如文書發往國中央機關認為該請求書不符合《公約》的規定，應及時通知申請者，并說明其對請求書的異議。對于符合《公約》規定的送達請求書，文書發往國只有在其認為執行請求將損害其主權或安全時才可拒絕執行，并應迅速通知申請者和說明拒絕的理由。《公約》規定的送達途徑有外交途徑和領事途徑，如果送達目的地國不持異議，還可通過郵寄方式，或通過負責送達的官員或訴訟利害關系人的方式，或通過締約雙方議定的直接送達方式送達。
